  1. END-USER LICENSE AGREEMENT FOR OUTLOOK EXPRESS BACKUP WIZARD

  3. IMPORTANT-READ CAREFULLY: This End User License Agreement
  4. ("EULA") is a legal agreement between you (either an individual
  5. or a single entity) and QSX Software Group for the software
  6. product identified above, which includes computer software
  7. and associated media, and may include electronic documentation
  8. ("SOFTWARE PRODUCT" or "SOFTWARE"). By installing, copying, or
  9. otherwise using the SOFTWARE PRODUCT, you agree to be bound by
  10. the terms of this EULA. If you do not agree to the terms
  11. of this EULA, promptly return the unused SOFTWARE PRODUCT to
  12. the place from which you obtained it for a full refund.
  13.  
  14. SOFTWARE PRODUCT LICENSE
  15.  
  16. The SOFTWARE PRODUCT is protected by copyright laws and
  17. international copyright treaties, as well as other
  18. intellectual property laws and treaties. The SOFTWARE
  19. PRODUCT is licensed, not sold.
  20.  
  21. 1. GRANT OF LICENSE
  22.  
  23. This EULA grants you the following rights:
  24.  
  25. You may install and use one copy of the SOFTWARE PRODUCT
  26. on a single computer at a time and only by one user at
  27. a time.
  28.  
  29. You may also store or install a copy of the SOFTWARE
  30. PRODUCT on a storage device, such as a network server, used
  31. only to install or run the SOFTWARE PRODUCT on your other
  32. computers over an internal network; however, you must acquire
  33. and dedicate a license for each separate computer on which
  34. the SOFTWARE PRODUCT is installed or run from the storage
  35. device.

  37. A license for the SOFTWARE PRODUCT may not be used concurrently
  38. on different computers, however, this agreement does allow a
  39. licensed user to install the SOFTWARE PRODUCT on both a work
  40. computer and a home computer, provided the SOFTWARE PRODUCT
  41. is not in use on both machines at the same time.

  44. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  46. You may not reverse engineer, decompile, or disassemble the
  47. SOFTWARE PRODUCT, except and only to the extent that such activity
  48. is expressly permitted by applicable law not withstanding this
  49. limitation.
  50.  
  51. The SOFTWARE PRODUCT is licensed as a single product. Its
  52. component parts may not be separated for use on more than
  53. one computer.
  54.  
  55. You may not rent or lease the SOFTWARE PRODUCT.
  56.  
  57. You may permanently transfer all of your rights under this
  58. EULA, provided you retain no copies, you transfer all of the
  59. SOFTWARE PRODUCT (including all component parts, the media and
  60. printed materials, any upgrades and this EULA), and the recipient
  61. agrees to the terms of this EULA. If the SOFTWARE PRODUCT is
  62. an upgrade, any transfer must include all prior versions of
  63. the SOFTWARE PRODUCT.

  65. Without prejudice to any other rights, QSX Software Group may
  66. terminate this EULA if you fail to comply with the terms and
  67. conditions of this EULA. In such event, you must destroy all
  68. copies of the SOFTWARE PRODUCT and all of its component parts.

  70. 3. UPGRADES
  71.  
  72. If the SOFTWARE PRODUCT is an upgrade from another product, you
  73. may use or transfer the SOFTWARE PRODUCT only in conjunction with
  74. that upgraded product, unless you destroy the upgraded product.
  75. If the SOFTWARE PRODUCT is an upgrade of a QSX Software Group
  76. product, you now may use that upgraded product only in accordance
  77. with this EULA. If the SOFTWARE PRODUCT is an upgrade of a
  78. component of a package of software programs that you licensed as
  79. a single product, the SOFTWARE PRODUCT may be used and transferred
  80. only as part of that single product package and may not be
  81. separated for use on more than one computer.

  83. 4. COPYRIGHT
  84.  
  85. All title and copyrights in and to the SOFTWARE PRODUCT
  86. (including but not limited to any images, photographs, animations,
  87. video, audio, music, text, and "applets," incorporated into the
  88. SOFTWARE PRODUCT), the accompanying printed materials, and any copies
  89. of the SOFTWARE PRODUCT, are owned by QSX Software Group. The
  90. SOFTWARE PRODUCT is protected by copyright laws and international
  91. treaty provisions.  Therefore, you must treat the SOFTWARE PRODUCT
  92. like any other copyrighted material except that you may either
  93. (a) make one copy of the SOFTWARE PRODUCT solely for backup or
  94. archival purposes, or (b) install the SOFTWARE PRODUCT on a single
  95. computer provided you keep the original solely for backup or
  96. archival purposes. You may not copy the printed materials
  97. accompanying the SOFTWARE PRODUCT.

  99. Microsoft« Outlook« Express is either a registered trademark or a
  100. trademark of Microsoft Corporation in the United States and/or
  101. other countries. Outlook Express Backup Wizard is a product of
  102. QSX Software Group and is not affiliated with Microsoft in any way.
  103. QSX Software Group is independent from Microsoft Corporation, and
  104. not affiliated with Microsoft in any manner.
  105.  
  106. LIMITED WARRANTY
  107.  
  108. NO WARRANTIES.
  109. The Author of this Software expressly disclaims any warranty for
  110. the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related
  111. documentation is provided "as is" without warranty of any kind,
  112. either express or implied, including, without limitation, the
  113. implied warranties or merchantability, fitness for a particular
  114. purpose, or noninfringement. The entire risk arising out of use
  115. or performance of the SOFTWARE PRODUCT remains with you.
  116.  
  117. NO LIABILITY FOR DAMAGES.
  118. In no event shall the author of this Software be liable for any
  119. damages whatsoever (including, without limitation, damages for
  120. loss of business profits, business interruption, loss of business
  121. information, or any other pecuniary loss) arising out of the use
  122. of or inability to use this product, even if the Author of this
  123. Software has been advised of the possibility of such damages.
